Michael Greve is a first-rate constitutional scholar, so I take on his argument that “the states will lose on Medicaid” with some trepidation. I’m no lawyer, so I’m in no position to quarrel with his legal argument. But I do know a thing or two about the Medicaid program and my analysis of the Affordable Care Act (ACA) leads to a very different conclusion.
